1. Introduction
These Terms & Conditions ("Terms") and the accompanying Privacy Policy (collectively, "Agreement") govern your use of the Hamy website (hamy.in) and Android application ("App"). The services are operated by Hamy Infotech Private Limited, 263153, Rudrapur, Near Bus Stand 100, Ward 32, Uttarakhand, India ("Hamy", "we", "our", "us").
This electronic record is published pursuant to Rule 3(1) of the Information Technology (Intermediaries Guidelines & Digital Media Ethics Code) Rules 2021 and does not require physical or digital signatures.
By accessing Hamy or creating an account, you confirm that you have read, understood, and agree to be bound by this Agreement. If you disagree with any part, please do not register or use our services.
2. Definitions
- Member / User – Any natural person who accesses Hamy, whether or not registered or paying.
- Service – All features, content, and functionality made available via the Hamy website or App.
- Content – All text, photos, videos, messages, or data posted or transmitted through the Service.
- Minor – Any person under 18 years of age.
- Harmful Content – Content that violates applicable laws, these Terms, or community standards.
3. Eligibility & Age Verification
- You must be legally competent to contract under Indian law.
- Minimum age: 18 years (women) or 21 years (men). We strictly enforce age verification.
- You must provide valid government-issued identification for age verification.
- You must intend to seek a lawful matrimonial alliance; casual dating or commercial use is prohibited.
- Zero Tolerance for Minors: Any attempt by minors to access the Service will result in immediate account termination and may be reported to authorities.
4. Child Safety & Protection (CSAE Policy)
Hamy has a strict zero-tolerance policy regarding child sexual abuse and exploitation (CSAE).
Prohibited Content & Activities:
- Any content that sexualizes, grooms, abuses, or otherwise harms children.
- Content that depicts, encourages, or promotes sexual abuse of minors.
- Sharing, requesting, or soliciting sexually explicit imagery of anyone under 18.
- Any attempt to meet, communicate with, or groom minors for sexual purposes.
- Content that facilitates the trafficking or commercial sexual exploitation of minors.
Detection & Enforcement:
- We employ automated systems and human reviewers to detect CSAE content.
- All reported violations are investigated within 24 hours.
- Violations result in immediate account termination and reporting to National Center for Missing & Exploited Children (NCMEC), local law enforcement, and relevant authorities.
- We cooperate fully with law enforcement investigations.

5. Acceptance & Duration
- These Terms remain in effect while you use the Service.
- You may terminate your membership at any time by emailing meetketanmehta@gmail.com. Refunds are subject to our Refund Policy (Section 16).
- Hamy may suspend or terminate access without notice to protect its interests, those of other Members, or compliance with legal requirements.
6. Enhanced Member Obligations
- Keep your login credentials confidential; you are responsible for all activity under your account.
- Provide accurate, current, and complete information. Duplicate, false, or misleading profiles may be removed.
- Age Verification: You must provide valid government-issued ID for age verification when requested.
- Use the Service only for lawful purposes; comply with all applicable laws, court orders, and governmental regulations.
- Enhanced Prohibited Activities:
- Harassment, hate speech, discrimination, or obscene content.
- Spamming, chain letters, or unsolicited mass messaging.
- Posting copyrighted material without permission.
- Soliciting money, financial information, or personal data from other users.
- Uploading pornographic, sexually explicit, or inappropriate content.
- Any content or activity that endangers minors or violates CSAE policies.
- Impersonation, catfishing, or creating fake profiles.
- Promoting violence, terrorism, or illegal activities.
- Sharing contact information in profiles or initial messages (safety measure).
- Automated scraping, bots, or circumvention of technical measures are forbidden.
- Reporting Obligation: Users must report suspected violations of these Terms, especially those involving safety concerns.
7. Content Moderation & Safety
Hamy employs comprehensive content moderation including automated systems, human reviewers, and user reporting to ensure platform safety.
- All uploaded content is screened before publication.
- We reserve the right to edit, refuse, or remove any content that violates these Terms.
- Users can report inappropriate content or behavior through in-app reporting tools.
- We maintain detailed logs of user interactions for safety and legal compliance.
- Repeat offenders face permanent suspension.
8. Enhanced Profile Verification
Mandatory Age Verification: All users must verify their age through government-issued ID. Additional verification may include:
- Photo verification to prevent catfishing.
- Phone number verification via OTP.
- Educational/professional credential verification (optional).
- Background checks for premium members (where legally permissible).
Verification documents are stored securely, encrypted, and never shared with other users.
9. Communications Consent & Safety
By registering you consent to receive emails, SMS, calls, and in-app notifications from Hamy and other Members. This consent overrides any DND / NCPR preferences.
Safety Features:
- Initial messages are monitored for inappropriate content.
- Users can block, report, or restrict communications from other users.
- Meeting suggestions include public places and safety tips.
10. Enhanced Disclaimers & Limitations
- While we implement robust verification and safety measures, users should exercise caution and meet in public places.
- Hamy does not guarantee the accuracy of all profile information and users should independently verify details.
- The Service is provided "as is" with continuous improvements to safety and security.
- We are not liable for interactions between Members, but we provide tools and support for safe communication.
- Our liability is limited to the fees you paid to Hamy in the preceding 12 months.
11. Proprietary Rights & User Content
All intellectual property on Hamy is owned by Hamy or its licensors. Users retain rights to their uploaded content but grant Hamy a license to use, display, and process such content for Service provision.

- Users consent to content being processed for safety screening.
- Hamy may retain certain content for legal compliance and safety purposes.
12. Jurisdiction & Legal Compliance
All disputes are subject to the laws of India and the exclusive jurisdiction of competent courts in Rudrapur, Uttarakhand. We comply with:
- Information Technology Act, 2000 and rules thereunder
- Personal Data Protection Bill (when enacted)
- Google Play Developer Policy
- International child safety regulations
13. Enhanced Indemnity
You agree to indemnify Hamy from claims arising from your use of the Service, violations of these Terms, infringement of laws, or harm to other users resulting from your actions.

- No Refunds for premium subscriptions after Purchase.
- No refunds for terminated accounts due to Terms violations.
17. Amendments
We may modify these Terms with 30 days' notice via email or in-app notification. Continued use constitutes acceptance. For material changes affecting safety or privacy, explicit consent may be required.

- Media Content: profile_images, videos, photos
- Authentication: password (encrypted)
